Lasting Power of Attorney

 

No matter how healthy and active we are today, we all worry about how we might cope in the future.

Mental health can deteriorate slowly or very quickly, and it may be difficult to deal with our personal affairs, and we may therefore need to have our interests safeguarded. If we appoint someone to act on our behalf in the event of such circumstances arising, we can feel more secure in the knowledge that someone we know and trust will act for us in the future should the need arise.

It is for this reason that we may wish to make a Lasting Power of  Attorney. The Lasting Power of Attorney needs to be made whilst we are in good health. It can cover property and finances together with decisions regarding welfare, and can also contain restrictions as to the powers given to the attorney.

More than one person can be appointed to act as attorney, and they can then either act jointly or independently. Alternatively, someone can be appointed to act in the event that the person appointed is unable to act.  

Once the Lasting Power of Attorney has been made, it has to be registered with the Office of Public Guardian immediately, and cannot be enforced unless it has been registered.

The Lasting Power of Attorney will only operate during the donor's lifetime, and ceases on death, when you will takes effect
